Precedent-Setting Internet Law Decision

Arshia was quoted in the Globe on the enforceability of browse-wrap terms under Canadian law in an article on the precedent-setting Century 21 decision on September 20, 2011. The Century 21 v. Zoocasa decision of the BC Supreme Court held that browse-wrap agreements are in fact enforceable in Canada. While The article stated: "Arshia Tabrizi, a Toronto technology lawyer, said that while the judgment leaves open what constitutes proper notice of a terms-of-use agreement, it clears up any questions about whether browse wrap contracts can be enforced." The article quoted Arshia: “So long as you have notice, just by browsing the site, you’re implicitly accepting the agreement, so there’s a contract formed,” Mr. Tabrizi said.
